Privacy in the nook of Facebook

Information pertaining to the private sphere of one's life is not a fixed and undisputed meaning in law, but rather it is contextually defined in consideration of the social environment of one's life, the perceptions, mentations, customs of a certain social environmental context, which might be in constant flux. There are no areas of life not governed by context-specific norms of information flow, and privacy is not an exception to this rule. People move into and out of a plurality of distinct contexts every day with a reasonable expectation for respect of their privacy, at least in EuropeIn this work, we're approaching the context of Facebook as a social networking site with the aim to understand the level of privacy and data protection related to it. This approach is affected by the sensitivity and regulation for data protection in effect in the E.U.

Η πνευματική ιδιοκτησία ως κλάδος της νομικής επιστήμης εδράζεται επί διεθνών συμβάσεων· δεν είναι ένας τομέας της εσωτερικής έννομης τάξης ενός κράτους όπου μπορεί να ρυθμίζεται το αντικείμενο αυτό χωρίς να λαμβάνονται υπόψη οι διεθνείς συμβάσεις, το κοινοτικό κεκτημένο που αφορά στα Κράτη-Μέλη της Ευρωπαϊκής Κοινότητας στην οποία ανήκει η Κύπρος, αλλά και οι διεθνείς πρακτικές κυρίως ενόψει της τεχνολογικής προόδου και κοινωνικής αποδοχής και χρήσης αυτής.

Copyleft through Open Educational Resources & Creative Commons

For those who keep pace with the latest developments in Copyright, nationally as well as internationally, it is common understanding that we've been in the transitional process of knowledge, science and culture furnished through Internet networking applications and Internet Protocol networks leveraging on Digital Libraries and repositories enhanced with Open Educational Resources (OER). The concept of Digital Libraries is not new, and is definitely well known to INTRACOM, a group of companies that is related to AIT. If I'm not wrong since 1994-almost during the last 15 years-INTRACOM Group has performed in the field of Digital Libraries through projects such as the NOMOS Digital Library. But the concept of Open Educational Resources is not something that INTRACOM and AIT have mastered, so far. The concept and contents of NOMOS are explicitly copyrighted; they are not copylefted.

Το αντικείμενο της σύντομης αυτής εισήγησης είναι οι άδειες εκμετάλλευσης έργων πνευματικής ιδιοκτησίας Creative Commons, όπως αυτές έχουν τεθεί στη διάθεση των δημιουργών και χρηστών έργων στην ελληνική τους έκδοση από τον Οκτώβρη του 2007, και η χρήση των αδειών αυτών για τη διάθεση στο κοινό οπτικοακουστικών έργων είτε απευθείας από το δημιουργό/δικαιούχο αυτών είτε μέσω ψηφιακών αποθετήριων τέτοιων έργων. Τα παραδείγματα είτε των αποθετήριων οπτικοακουστικών έργων είτε απλά διατιθέμενων οπτικοακουστικών έργων στα οποία θ' αναφερθώ προς το τέλος της εισήγησης αυτής κάνουν χρήση των αδειών Creative Commons, και έτσι τόσο ο δημιουργός/δικαιούχος οπτικοακουστικού έργου όσο και ο χρήστης αυτού μπορούν να κάνουν σύννομη χρήση των αποθετηριών ή έργων και του περιεχομένου τους επί των οποίων υφίστανται δικαιώματα πνευματικής ιδιοκτησίας.

Hellenic National Audiovisual Archive (HeNAA) is an organization that evolves into a Digital Library (DL) leveraging on technological applications for making available online audiovisual works. An architectural element of DL is the application of Peer-to-Peer (P2P) technologies. The application of P2P in DL is not been seen positively by content-providers and subsequent right-holders of copyright. P2P is targeted and is exposed to fire in most cases from content providers and subsequent right-holders who have interwoven their business interests and business models with the commercial availability of content online. However, P2P per se is a technological system that was not invented to facilitate copyright infringement; rather, it is a technological solution to a problem of computer network architecture. Also, P2P represents a great technological advantage in information and communication core technological infrastructure for the evolution of DL such as HeNAA. In this short whitepaper we pose the question if it is possible to have a system for non-commercial use of intellectual property in consideration of free P2P file-sharing. We express the opinion that a solution to the problem of P2P file-sharing could come only if the focus is on the process to legitimize P2P file-sharing on condition of proper respect and due payment of the equitable remuneration as is provided by law aiming at fair compensation of authors and creators, and a balancing of the interests of all the involved parties, i.e. creators, subsequent right-holders, and the general public, in the process of making available copyrighted works online.

Το αντικείμενο της εισήγησης αυτής είναι οι άδειες εκμετάλλευσης έργων πνευματικής ιδιοκτησίας Creative Commons, όπως αυτές έχουν τεθεί στη διάθεση των δημιουργών και χρηστών έργων στην ελληνική τους έκδοση, και η χρήση των αδειών αυτών για τη διάθεση στο κοινό μουσικών έργων είτε απευθείας από το δημιουργό/δικαιούχο αυτών είτε μέσω ψηφιακών αποθετήριων μουσικών έργων. Ο θεσμός της χορηγίας όπως επινοήθηκε και υιοθετήθηκε στην πατρογονική ελληνική κληρονομιά μας, συγκαταλέγονταν στις τέσσερις σημαντικές κοινωνικές λειτουργίες (χορηγία, γυμνασιαρχία, τριηραρχία και εστίαση) χάρις στις οποίες κατέστη δυνατή η οικονομική ευημερία της Ελληνικής Πόλης-Κράτους με ισόρροπο διαμοιρασμό του βάρους της οικονομικής ανάπτυξης του κοινωνικού συνόλου κατά την αναλογία της ευημερίας των πολιτών-μελών του κοινωνικού συνόλου. Η χορηγία ήταν υποχρεωτική με νόμο για τους 120 πιο εύπορους πολίτες από κάθε μία από τις δέκα φυλές της Αθήνας. Με τη νομοθετική παρέμβαση για την υποχρέωση χορηγίας, οι πρόγονοί μας αναδείκνυαν τη σημασία της οικονομικής-κυρίως-συνδρομής αναλογικά με τη δυνατότητα γι' αυτήν των εύπορων συμπολιτών τους, έτσι ώστε οι άποροι να μπορούν ν' απολαμβάνουν τα αγαθά της ευημερούσας κοινωνίας χωρίς κοινωνικούς αποκλεισμούς εκπορευόμενους από την άνιση κατανομή του πλούτου στο κοινωνικό σύνολο.

Η ευκολία με την οποία επικοινωνεί κάποιος ανώνυμα στο διαδίκτυο τις ιδέες του είναι απαράμιλλη συγκριτικά με τις δυνατότητες ανώνυμης επικοινωνίας με χρήση οποιουδήποτε άλλου μέσου. Η πρόσφατη ειδησεογραφική επικαιρότητα με τις πάμπολλες τηλεοπτικές αψιμαχίες και παραθυρολογίες δείχνει ότι η ανώνυμη επικοινωνία στο διαδίκτυο, ενόψει της τεχνολογικής ευκολίας για να επιτευχθεί, έχει προβληματίσει μέρος διαμορφωτών της κοινής γνώμης αλλά και των χρηστών των διαδικτυακών εφαρμογών, προϊόντων και υπηρεσιών, με επίκεντρο του προβληματισμού τις δυσμενείς συνέπειες της ανώνυμης επικοινωνίας αναφορικά με τη διαφύλαξη και προστασία των ατομικών δικαιωμάτων των θιγόμενων πολιτών από ανώνυμες και νομικά κολάσιμες επικοινωνίες. Ενόψει του προβληματισμού αυτού δεν είναι λίγες οι φωνές εκείνων που ζητούν από τη Νομοθετική Εξουσία να θεσπίσει πρόσθετο πλαίσιο κανόνων δικαίου για την αντιμετώπιση της ανώνυμης επικοινωνίας στο διαδίκτυο σταθμίζοντας τα πλεονεκτήματα και μειονεκτήματα της ανώνυμης επικοινωνίας.

Αφορμή για τη συγγραφή του παρόντος άρθρου έδωσε η εξωδικαστική δήλωση, διαμαρτυρία και πρόσκληση εταιρίας παροχής συνδρομητικών τηλεοπτικών και ραδιοφωνικών προγραμμάτων προς τους νόμιμους εκπροσώπους και συνιδιοκτήτες μηνιαίου περιοδικού για την ψηφιακή και δορυφορική τηλεόραση. Η εξωδικαστική ενέργεια της εταιρίας παρόχου συνδρομητικών υπηρεσιών δικαιολογήθηκε από την εταιρία πάροχο συνδρομητικών υπηρεσιών ενόψει δημοσιευμάτων του περιοδικού περί των τεχνικών μεθόδων και των επιμέρους χαρακτηριστικών τους για την πρόσβαση σε προστατευμένη υπηρεσία, όπως αυτή της εκπομπής τηλεοπτικών και ραδιοφωνικών συνδρομητικών προγραμμάτων. Η εταιρία πάροχος θεώρησε ότι η εν λόγω δημοσιεύσεις περί το μοίρασμα των έξυπνων καρτών για την ενεργοποίηση της παροχής συνδρομητικών υπηρεσιών είναι παράνομη ενέργεια και υποκινεί τους αναγνώστες του περιοδικού σε παράνομο card - sharing .

Ποιοι είναι οι μηχανισμοί εκείνοι που θα μπορούσαν να επιφέρουν την αποδοτικότερη προστασία για την πνευματική ιδιοκτησία στο διαδίκτυο; Δύο είδη της προστασίας είναι σήμερα εφικτά. Το πρώτο αφορά στην παραδοσιακή προστασία του νόμου, δηλαδή το νομικό πλαίσιο προσδιορίζει ένα χώρο στον κυβερνοχώρο όπου άλλοι δεν επιτρέπεται να εισαχθούν και τιμωρεί αυτούς που παρά την ισχύουσα απαγόρευση αποπειρώνται ή/και επιτυγχάνουν να εισαχθούν παρανόμως και να ιδιοποιηθούν ή να κάνουν οποιαδήποτε άλλη χρήση προϊόντων πνευματικής ιδιοκτησίας χωρίς τη συναίνεση του δικαιούχου. Η δεύτερη μορφή προστασίας αφορά στη λήψη των καταλλήλων μέτρων για την παρεμπόδιση, τη φραγή της ανεπιθύμητης εισόδου στον προσδιορισμένο χώρο στον κυβερνοχώρο στον οποίο αποθέτουν οι δικαιούχοι έργα υπαγόμενα στις προστατευτικές διατάξεις του νόμου για την πνευματική ιδιοκτησία. Η δεύτερη μορφή προστασίας θα μπορούσε να γίνει κατανοητή ως ένας τεχνολογικός φράκτης ο οποίος ως επί το πλείστον έχει την μορφή λογισμικού κώδικα ( software ) που εμποδίζει τους ανεπιθύμητους και κακόβουλους χρήστες που επιβουλεύονται τα έργα διανοίας των δημιουργών βρισκόμενα στο διαδίκτυο.

Έχει επικρατήσει στην τρέχουσα ορολογία των επιστημόνων που ασχολούνται με το περί ου ο λόγος θέμα ο αρκετά ευρύς και ενδεχομένως ασαφής όρος « Mobility » με σκοπό την περιγραφή της δυνατότητας του χρήστη των τηλεπικοινωνιακών συστημάτων να επικοινωνεί από οποιοδήποτε σημείο με οποιονδήποτε- anytime , anywhere , όπως χαρακτηριστικά λέγεται. Ο όρος αυτός συνδέεται κυρίως με τις τεχνολογίες για κινητές επικοινωνίες όπως οι τεχνολογίες GSM , DCS -1800, UMTS , GPRS , Ultra Wideband Networks , TETRA Networks , Integrated Dispatch Enhanced Networks WiFi , WiMax , Bluetooth , κλπ. Τα Δίκτυα Επόμενης Γενιάς ( NGN = Next Generation Networks ) βασισμένα στο πρωτόκολλο ΙΡ, θα είναι ικανά να παρέχουν ευρυζωνική ροή δεδομένων και να υποστηρίζουν πολλαπλές Quality - of - Service τεχνολογίες ανεξάρτητα από τις τεχνολογικές υποδομές τους και θα επιτρέπουν τη πλήρη κινητικότητα των χρηστών, οι οποίοι θα μπορούν να συνδέονται από κάθε σημείο με οποιονδήποτε, χρησιμοποιώντας διαφόρων τεχνολογιών υποδομές και τερματικές συσκευές.

Legal Considerations for Regulating Content on the Internet in Lithuania

The issue of regulating content on the Internet stems from a debate between those who believe that the state has a role to ensure that harmful content is prohibited and those who believe that the individual must have a right to choose. Governments seek to re-regulate access to speech on the Internet so as to establish local control. In democratic regimes regulating content on the Internet appears to be a means to accommodate legal and cultural reservations about unfettered communications without building unnecessary new barriers to electronic commerce. In this whitepaper, we examine the issue of regulating content on the Internet and its side-effects such as censoring for the sake of protecting minors from harmful and illegal content on the Internet. Our analysis is conducted under the prism of existing regulation in Greece and the regulatory situation in the European Union, mainly.

The term "Wardriving" is used in order to describe that practice at which an individual, an Internet user, wanders in the streets of districts equipped with electronic devices capable for wireless access to the Internet with the aim to locate wireless networks for access to the Internet, either house-based or corporate-based wireless networks, map their existence for statistical or any other reason, and hack them.

Στα λόγια του Thomas Jefferson, «Αυτός που λαμβάνει μια ιδέα από εμένα, εμπνέεται χωρίς εγώ να χάνω την ιδέα. Αυτός που ανάβει το κερί του από το δικό μου, φωτίζεται χωρίς να με συσκοτίζει» είδε ο Καθηγητής Νομικής Lawrence Lessig την κεντρική ιδέα των Creative Commons, δηλαδή την ευρύτατα, πλέον, διαδεδομένη αντίληψη ότι η βέλτιστη εκμετάλλευση των πνευματικών δικαιωμάτων ή η διάδοση του έργου των δημιουργών γίνεται σήμερα, στην ψηφιακή εποχή και κοινωνία των διαδικτυακών επικοινωνιών, με αποτελεσματικό τρόπο, όταν μέρος από το περιουσιακό δικαίωμα των δημιουργών υποχωρεί προς όφελος των χρηστών ή των άλλων δημιουργών. Η μέγιστη διάδοση συγκεκριμένων τύπων έργων ή η εφαρμογή συγκεκριμένων επιχειρηματικών μοντέλων επιτυγχάνεται στον ψηφιακό κόσμο με τη διάθεση των εξουσιών αναπαραγωγής, μεταβολής και διάθεσης του έργου.

Οι «φυγόστρατοι» αποτελούν βαθιά πληγή στο σώμα της κοινωνία μας. Όσα έγιναν γνωστά τις τελευταίες ημέρες δείχνουν για μία ακόμη φορά την αδυναμία της πολιτείας να την επουλώσει. Μένει κανείς με την εντύπωση ότι οι ευθύνες μετατίθενται «από τον Άννα στον Καϊάφα», χωρίς κανένα αποτέλεσμα. Αφού άνοιξε το απόστημα, πρέπει να δούμε πώς θα αντιμετωπίσουμε ένα πρόβλημα που προσβάλλει την ισοπολιτεία και τραυματίζει καίρια μια δικαιοκρατούμενη πολιτεία. Ένα πρόβλημα που αποτελεί ντροπή για τον πολιτισμό μας.

There is a claim that supports the legality in waiving of privacy protection and secrecy of communication as foreseen by the Law in Greece regarding crimes others than those provisioned by article 4§1 of L.2225/1994 without the increased guarantees and the process provided by the legal framework that is set in force pursuant to article 19 of the Greek Constitution. If we were to accept the sustainability of said claim, we would have violated the principle of proportionality between any restriction of the human right in the secrecy of communication in any possible way and the sought aim of said restriction for the sake of confrontation of crime. Violation of the principle of proportionality which is provisioned by article 25§1(d) of the Greek Constitution could pave the way for any violent and offending penetration of the core of many more human rights, constitutionally safeguarded, and could inevitably lead to an unconstitutional status quo.

Το ζήτημα της ρύθμισης του περιεχομένου στο διαδίκτυο είναι μέρος μιας εν εξελίξει αντιπαράθεσης μεταξύ εκείνων που θεωρούν ότι το κράτος έχει έναν ρόλο παίξει για να αποτρέψει την πρόσβαση των πολιτών σε επιβλαβές ή/και παράνομο περιεχόμενο στο διαδίκτυο και εκείνων που θεωρούν ότι το άτομο-και όχι το κράτος-πρέπει να έχει το δικαίωμα να επιλέξει το περιεχόμενο στο οποίο έχει πρόσβαση μέσω του διαδικτύου. Είναι προφανές ότι η εν λόγω αντιπαράθεση αφορά κυρίως στην προστασία των ατομικών δικαιωμάτων των πολιτών σχετικά με τον έλεγχο του περιεχομένου στο διαδίκτυο.

Ο όρος « Wardriving »χρησιμοποιείται για να περιγράψει την πρακτική εκείνη κατά την οποία ένας χρήστης του Διαδικτύου περιπλανιέται στους δρόμους συνοικιών εφοδιασμένος με συσκευή που έχει δυνατότητα ασύρματης πρόσβασης στο Διαδίκτυο με σκοπό να εντοπίσει ασύρματα δίκτυα πρόσβασης στο Διαδίκτυο οικιακής ή επαγγελματικής χρήσης και να χαρτογραφήσει την ύπαρξή τους για στατιστικούς ή άλλους λόγους. Για τη δημοσιοποίηση στοιχείων που αφορούν σε ασύρματα δίκτυα, οικιακής ή επαγγελματικής χρήσης, που χρησιμοποιούνται και για την πρόσβαση στο Διαδίκτυο, χρησιμοποιείται ο όρος « Warchalking ». Στο παρόν whitepaper εξετάζονται διάφορες πτυχές του Wardriving και Warchalking ως ειδικότερες εκφάνσεις hacking , γίνεται αναφορά στην επιχειρηματολογία εκείνων που πρεσβεύουν στη νομιμότητα των εν λόγω πράξεων, γίνεται ανάλυση στην ποινική και αστική αντιμετώπιση των πράξεων αυτών από το ελληνικό δίκαιο, αλλά και κριτική για την ορθότητα του παρόντος θεσμικού πλαισίου.

Phishing: Η νέα μέθοδος εξαπάτησης στο Διαδίκτυο.

Το Phishing είναι μια νέα μέθοδος εξαπάτησης των καταναλωτών ενός οργανισμού, συνήθως κερδοσκοπικού, και συνίσταται κυρίως στην απατηλή υφαρπαγή των εμπιστευτικών πληροφοριών των καταναλωτών, όπως προσωπικά ή ευαίσθητα δεδομένα, οικονομικά δεδομένα κλπ, με σκοπό την παράνομη χρήση τους από τον Phisher για την πρόκληση βλάβης ξένης περιουσίας. Με τη βοήθεια κυρίως της απρόσκλητης εμπορικής επικοινωνίας-το γνωστό Spam -ή χρησιμοποιώντας bots για την αυτοματοποιημένη στόχευση των υποψήφιων θυμάτων τους ή άλλες παρόμοιες μεθόδους, οι Phishers , εμφανιζόμενοι κυρίως στο διαδίκτυο ως εκπρόσωποι ενός οργανισμού τα χαρακτηριστικά του οποίου έχουν αντιγράψει παράνομα, προβαίνουν σε δόλιες πράξεις ή παραλείψεις με τις οποίες πείθουν τα στοχευμένα θύματά τους, τα οποία ενδέχεται να είναι άδηλα , ν' αποκαλύψουν ή εισάγουν σε σύστημα ηλεκτρονικών υπολογιστών στοιχεία της ταυτότητάς τους και εμπιστευτικές πληροφορίες με σκοπό να χρησιμοποιήσουν οι Phishers αυτές τις πληροφορίες για να προσπορίσουν στον εαυτό τους ή τρίτον παράνομο περιουσιακό όφελος προξενώντας βλάβη σε περιουσιακά στοιχεία των θυμάτων τους.

More often than not consumers actively resist marketing. So it's important to avoid marketing at people. Rather, the creation of an environment wherein consumers may market to each other could improve marketing's effectiveness. This idea does not comply with direct marketing at people in the form of unsolicited commercial communication, i.e. spam!
